The defense of João Paulino, the acknowledged author of the gun theft from Tancos, appealed to the Constitutional Court against the Relação de Évora’s decision on the issue of the legality of the evidence already contested by the defendant in the instruction.
In an appeal to the Constitutional Court (CC), lawyer Melo Alves also claims unconstitutionality related to the “lack of assistance and control from the prosecutor’s office (MP)” in relation to the investigative actions that took place in the Tancos trial, which even included a parallel investigation of the Military Judicial police/GNR.
In the appeal, to which Lusa had access, João Paulino’s defense alleges that the defendant, during the investigation phase, asked the court “several questions, namely regarding the lawfulness of the evidence”, but that the investigating court “is not pronounced”.
