The 19-year-old robber will receive compensation in the amount of 40 thousand euros for hitting a car while robbing a residential building. It happened in 2019 in Guimarães.
The thief, Paulo Pinto, was hit by the owner of the residence, eventually suing the man for damages and demanding around 80,000 euros in damages. Paulo was given a suspended sentence for the robbery.
The Court of Appeal of Guimarães (TRG) decided to grant the attacker the right and ordered the driver’s insurance company to pay the amount of 32,352 euros in the first instance. Now the court has increased the compensation, and the attacker will receive 40,000 euros.
According to the national press, the TRG’s decision recognizes that “in the event of a suspected crime of theft at the scene of the crime, the law allows detention by any person, if he is absent or can be summoned.” promptly to the competent judicial or police authority”, but concludes that “the means used in carrying out such an arrest cannot be excessive or disproportionate”.
The owner of the property also stood trial for attempted murder.
The insurance company disputed the claim, stating that “Even if hit-and-run was proven, it was not required to pay damages in cases where the use of the vehicle contributes to the work of the agent, and the agent is fully responsible.” An argument that the judges did not accept.
