Miguel, the new witness, admits he doesn’t know any of the defendants.
“On March 18, I was with friends at MOME, and around six in the morning we were standing at the door when we saw a mess,” says Miguel.
The witness was at the scene waiting for an Uber.
“I managed to see someone on the ground, now I know it was Fabio Guerra,” adds Miguel, assuring that he did not see the start of the fight.
“I saw Claudio hit Fabio Guerra,” he recalls.
The cry of Fabio Guerra’s mother is heard, who is embraced by her husband and daughter.
He later said he was not sure if the victim was kicked or punched.
Miguel recalls hearing Clovis shout “I am King Montijo”.
The Ministry of Defense asks to verify the witness with what he said in the joint venture, as there are discrepancies, the prosecutor emphasizes.

The witness claims that he was attacked by two people at the disco and nothing kept him waiting. One of them headbutted the witness while they were on the dance floor. A witness identifies the author of the headbutt as Claudio Coimbra, one of the accused former shooters.
The witness reacted and punched the former Marine before being escorted off the premises by security. According to him, after leaving, he was taken away by friends. The police were on site at the time of the attacks, according to a witness who would have learned about this detail from acquaintances, since he was unconscious.
Vadim’s lawyer asks: “Did he get attacked for no reason?” The witness answers yes.
The witness says he was not drunk, despite drinking. As he leaves, he says that he saw Vadim greet the guard.
A witness sees a video of him leaving the club to confirm who the guard was who made him leave. Looking at the images, you can see the moment he left, at 5:59 am.
The pictures show the witness again at 6:19 am. She stopped and walks forward with a friend.

Witness heard during videoconference says she was threatened
The witness being questioned says that he does not want to speak because he is afraid, says that they were threatened.
The judge says that the balance point should have heard the witness via videoconference. He doesn’t want to show his face. The judge wants you to see the face.

Claudio claims he was attacked, he doesn’t know who. Who grabbed him. But he doesn’t remember if anyone punched or kicked him. He admits he drank.
Unlike the first defendant, Claudio says no one harassed them. About the guard from Sesimbra, he says that “they don’t always go together, we are acquaintances.”
Claudio speaks for a minute and a half of more or less aggression. “Action, reaction,” he says.
He says he was afraid something would happen.
The judge asks: “And if a person is on the ground, then what is his fear? Where does the fear come from?”
“Fear was attacked from behind. I was afraid for my physical integrity,” says Claudio. “Is this what happens in the ring?” the judge asks.
Claudio has already been stabbed in an attempted robbery. He has a scar.

Claudio Coimbra begin to hear. The judge asks if he was in the Marines in March 2022. Claudio says yes, that he had military training.
He admits to having knowledge of self-defense and physical ability well above average..
It is recognized that they took lessons in personal preparation. The judge asks what it consists of.
They were part of a special formation, they go first. Claudio confirms. He says he attended a few classes, but nothing intense.

Claudio says there were no blows. That it happened at 4 or 5 in the morning and that they didn’t leave until six.
ABOUT the defendant says that already outside one of the PSP agents is punching Pereira in the face. He also tries to kick but fails. The judge laughs.
Claudio says that someone hit him in the street. Who came up from behind and hit him in the face.
He says he looked back, but they grabbed him. The judge insists: “You got hit and did nothing? Did you turn the other cheek?”
Claudio says he was the victim of a rear naked choke and the judge asks, “But is it easy to escape a rear naked choke?”
The defendant claims to have free images.
The judge interrupts the defendant. He says that the story is very complicated, he does not understand it well.
“Who hit you from behind? It was the victim (Fabio), I found out about it only later, after talking with my lawyers. who was the victim,” says Claudio.
The referee asks: “When they started to leave the place. Didn’t they come back? There were no more clashes? Then they were with security at the disco.”
Claudio says no.
“Does the prosecution say that the agent even chased you and then kicked you? Is that true?” the judge asks.
Claudio says no again.
“Is there anything else you want to tell me?” the judge asks. The defendant says no.
Claudio says he “knew he was going to be in trouble”. He says that he went in his car and drove Vadim home. Afterwards, he spoke to Corporal Fonseca to let him know what had happened and they sent him to the base.
The judge asks: “Who stabbed Fabio Guerra?”. Claudio says it was Vadim.
Fabio Guerra’s lawyer asks Vadim about
Lawyer Ricardo Serrano Vieira, representing the Fabio Guerra family, is now appearing in court. Vadim asks if the commander called or the commander was called.

Vadym diz que não tem noção do tempo. Diz que foi tudo muito rápido, não sabe quanto tempo dura.
“Sabe qual é a modalidade em concreto de boxe?”, pergunta a defesa de Cláudio. Responde que é boxe normal.
A Marinha administrou aulas de defesa pessoal? Perguntam. Vadym volta a insistir que não, apenas técnicas para algemar. Juíza diz que depende se isso é considerado ou não defesa pessoal.
Perguntam se Vadym sabia que podiam ser presos. Responde que sim porque começaram a sair muitas notícias. A juíza pergunta o que é que viu. Ele diz que previu que ia ficar preso, pôs essa possibilidade.
Vadym sai da sala e é ouvido Cláudio Coimbra.
Arguido Vadym conta o que aconteceu na noite em que o agente Fábio Guerra foi agredido
O arguido Vadym, de 23 anos, fala em tribunal. Cláudio é retirado da sala.
“Em março de 2022 era militar da marinha dos fuzileiros e colega de Cláudio”, afirma a juíza como um facto. Destaca que tiveram formação militar na força especial da Marinha e questiona Vadym se tinha conhecimentos de defesa pessoal acima da média.
Vadym admite ter preparação física acima da média mas não conhecimentos de defesa pessoal. O arguido destaca que Cláudio tem conhecimentos de boxe.
Diz que estava só com o Cláudio e o Clovis, na noite trágica. Às 6h estavam ainda na pista de dança. Quando começa a confusão com Cláudio Pereira. Diz que Cláudio Coimbra empurra o Pereira. Viu pelo movimento corporal. Estavam a tentar passar no mesmo espaço, estava muito cheio às 6 da manhã. Era numa entrada, estava tudo a passar ao mesmo tempo. Diz que só viu o empurrão.
Assegura que não intervém neste primeiro confronto, nem desferiu um murro.
Apercebeu-se da chegada do segurança a expulsar o Pereira. Aproximou-se da confusão mas volta a assegurar que não intervém.
Depois do empurrão, o Pereira afastou-se. A juíza diz que esse não é um comportamento normal.
Diz que não viu ninguém com sangue, pelo menos, na fase inicial. Cláudio Pereira não estava com nenhum amigo dentro da discoteca, diz. “Ele foi expulso uma hora antes de nós termos saído da discoteca”, reforça. “Saímos por volta das 6h da manhã”, acrescenta.
“Quando chegámos cá fora estava um segurança na porta, de Sesimbra, que nós conhecíamos. Abracámo-nos. Sai da discoteca com o Coimbra”, explica.
Depois o Pereira dá uma soco no Cláudio Coimbra. Depois Vadym tenta defendê-lo. A juíza questiona: “Mas sendo praticante de boxe precisava da sua ajuda?”
Vadym refere que estavam 20 pessoas com o Pereira. Pensou que grande parte estava com ele.
Os seguranças empurraram Pereira, conta. Mas diz não saber quem eram. Depois do Coimbra levar um soco, Vadym admite ter dado um soco ao Pereira, na cara.
“E ele caiu inanimado”, refere.
Conta que Cláudio Coimbra e Clodis aproximaram-se de Pereira para tentar dar pontapés. Juíza diz: “Porque é que não deram?” Vadym: “Não acertaram, deram pontapés para o ar”.
A juíza vai interrompendo muitas vezes. Vai falando de outros amigos que estavam com eles. Depois de repente olha para a frente e à volta do Clovis e do Coimbra viu um grande número de pessoas.
“Talvez seis, sete”, descreve.
Estavam a dar socos ao Coimbra, conta. A juíza pergunta: “Não fez nada?”. Vadym refere: “Eu tentei defendê-lo. Dei um soco num rapaz que tinha dado um soco ao Cláudio”.
“O senhor Cláudio parece que não se consegue defender?”, pergunta a juíza.
“O Coimbra não conseguiu defender-se? Nem o boxe o ajudou?”, refere ainda.
“Não sei, não vi se ele se defendeu”, diz o arguido que garante não ter ouvido ninguém a dizer que eram agentes da PSP.
O pai de Fábio vai chorando enquanto ouve o depoimento.
“Não ouvi nada”, afirma Vadym que só se lembra de dar um soco para defender o Cláudio.
“Tentei afastar com um pontapé”, refere ainda o arguido sobre o momento em que Fábio Guerra já estava no chão.
“O pontapé só tinha intenção de afastar as pessoas que tinham uma postura agressiva”, acrescenta.
“Não havia outras maneiras?”, pergunta a juíza.
Depois fomos em passo acelerado para o carro. Fugi porque estávamos a ser agredidos.
“Mas estavam a fugir de quem? Não estavam já todos no chão?, questionam os juízes.
“Estávamos a fugir da situação. Não sabíamos o que podia vir a seguir”, diz Vadym.
A acusação diz que Vadym ainda bateu numa pessoa mas este refere não se lembrar de nada.
Vadym diz que não viu pedras. Fala de uma mulher que tenta parar as agressões. Diz que foram para casa depois foram contactados para se apresentarem a um juíz pelo que fizeram. Isto acontece numa sexta e os arguidos apresentam-se no sábado.
A juíza questiona como é que acabou a noite e se voltaram à discoteca. Vadym diz que não, que não voltaram ao mesmo local e que nesse percurso não houve pontapés.
Diz que ainda há uma pessoa que vai atrás deles. Refere que é nesse momento que dá um pontapé.
“Sabe se Coimbra é campeão de boxe?”, pergunta a juíza. “Amador, sim”, refere o arguido.
Um dos juízes começa a questionar Vadym. Juíz não entende porque o “fugir da confusão”, insiste que Vadym explique de que é que fugia.
Vadym diz que tinha medo que fossem atrás deles. Diz que tinha receio de agressões.
Olharam para trás e viram alguém no chão? Questionam.
“Porque é que o segurança não vai socorrer mas depois liga a avisar que as vítimas são agentes da PSP?”, questiona.
“Na altura não sabia que eram agentes”, refere o arguido.
O procurador questiona: “Qual era a preparação militar de Vadym?”.
Estava na Marinha desde 2018. Tirou o curso de fuzileiros. Dentro da Marinha preparavam para ir em missão. Preparação física, treino. Afirma não ter tido defesa pessoal no curso dos fuzileiros. Procurador questiona em que é que consistiu o curso.
Vadym insiste que não havia nada de defesa pessoal. Diz que só aprendeu a algemar.
Procurador: “Qual é que era a sua perspetiva para dizer que os pontapés não acertam e são no ar?”
Vadym responde: “Tinha pessoas em pé, à minha frente, mas dava para ver o corpo no chão e pés a passar ao lado.”
Juíza: “Mas há alguma explicação para não se acertar num corpo no chão?”
Procurador: “Dá um primeiro soco ao Pereira. Depois dá outro noutra pessoa. Essa pessoa cai inanimada? Qual era a sua postura?”
Vadym: “Sim, cai. Afastei-o com um pontapé. Mas não estava inanimado”.
Procurador questiona se alguém gritou alguma coisa, para além da mulher que pedia para pararem. Vadym diz que não.
Defesa de Cláudio: “Não é por ter morrido uma pessoa que temos de descarregar nos arguidos”
A defesa de Cláudio culpa a comunicação social pelo palco que deu ao caso. Explica que Cláudio Pereira, a vítima que Fábio Guerra e os colegas foram ajudar, se desentendeu com os arguidos dentro do estabelecimento e que foi colocado na rua. Garantem que esteve muito tempo a fazer uma espera ao arguido Cláudio Coimbra.
Quando Cláudio Coimbra sai do estabelecimento, Cláudio Pereira agride-o, conta a defesa. Está a decorrer um processo por causa desta agressão.
“Não é por ter morrido uma pessoa que temos de descarregar nos arguidos”, dizem os advogados.
Defesa de Cláudio diz que não há sangue na cabeça de Fábio, que não há hemorragias na cabeça. Pai de Fábio fica inconsolável quando se fala da autópsia.
Nas imagens é possível ver Fábio Guerra a cair, garantem. A causa da morte segundo a defesa foi por Fábio ter sido atingido com algo na cabeça. Advogados lançam a dúvida se as agressões foram a causa da morte.
“Há gravações de todos os acontecimentos”, afirma defesa de Vadym
A defesa de Vadym Hrynko reforça que “há gravações de todos os acontecimentos”. Alegam que os agentes da PSP não vão em direção à vítima mas sim dos arguidos.
“É normal que os arguidos não tenham ouvido quando os agentes diziam ‘parem nós somos da polícia'”, acrescentam.
Vão apresentar o relatório de medicina legal que mostra que Fábio Guerra tinha uma aneurisma.
Consultor João de Sousa afastado da defesa
O consultor João de Sousa ri-se enquanto o Ministério Público defende que deve permanecer sentado e não junto da defesa.
A juíza refere que tinha negado a presença do consultor. Portanto, mantém-se. O consultor fica junto ao público e não pode ter computador.
Arguidos já estão na sala
Arguidos entram em tribunal. Pai de Fábio Guerra está inconsolável e é confortado pela filha. É a primeira vez que está frente a frente com os alegados homicidas do filho.
Os dois arguidos, Cláudio Coimbra e Vadym Hrynko, estão de fato e claramente calmos.

O pai de Fábio Guerra já está em tribunal e está visivelmente emocionado. É a primeira vez que irá ver os arguidos.
A mãe de Fábio Guerra e vários agentes da PSP não podem entrar porque são assistentes no processo. Só entram depois dos arguidos falarem.
Família dos arguidos e ex-fuzileiros presentes
A família de Claúdio Coimbra já está na sala. Estão a poucos metros de pai de Fábio.
Também estão na sala alguns colegas dos ex-fuzileiros que cumprimentam as famílias dos arguidos.
Aníbal Pinto assegura que Clóvis Abreu está disponível para colaborar com a justiça
Aníbal Pinto, o advogado de Clóvis Abreu, o terceiro suspeito que as autoridades nunca encontraram e que não se apresentou, assegurou, esta terça-feira, à entrada do Campus de Justiça, que o cliente está disponível para se apresentar quando for chamado pelo Ministério Público e para colaborar com a justiça.
“Ainda não se apresentou porque não foi chamado”, afirmou Aníbal Pinto. “Não faço a mínima ideia se está em Portugal ou não, mas se soubesse, também não dizia”, acrescentou.
Arguidos e advogados já chegaram ao Campus de Justiça
Os arguidos Cláudio Coimbra e Vadym Hrynko, os dois ex-fuzileiros acusados de matar Fábio Guerra, já se encontram no Campus de Justiça para começarem a ser julgados. Os advogados também já chegaram ao local.
Há dezenas de pessoas à aguardar para assistir ao julgamento.
