This Monday, the President of the Republic promulgated the government’s decree on the change of legal regimes in the field of housing construction, albeit with criticism of its content and in view of the fact that it had to be submitted to Parliament.
The enactment of this decree-law, approved by the Council of Ministers on March 30, was announced this Monday through a note on the official website of the President of the Republic on the Internet.
According to Marcelo Rebelo de Souza, “a real diploma had to be submitted to the Assembly of the Republic for political reasons, since it is not simply organic or procedural, but rather creates a new leasing regime for sublease and is partly compatible with, with the proposal of the law just passed by Parliament “.
“On the other hand, he does not use the opportunity to delve into the restoration of the main institutions for its application and does not wait for the two studies commissioned by the government, which have already begun and which could benefit from its content,” criticizes the head of state.
In his opinion, “strictly speaking, this diploma, not presented in the Assembly of the Republic, should at least wait until the end of the ongoing legislative process.”
“However, in view of the very tight deadlines for the implementation of an ambitious housing program approved by the Government, in which more or less than six months are of great importance, and not to create obstacles in a diploma in which there is neither a fundamental reason nor a clear impracticability, the President of the Republic promulgated the diploma, which changes several legal regimes in the field of housing,” justifies Marcelo Rebelo de Souza.
This Decree-Law is part of a package of legislative acts implementing the Mais Habitação measures, presented on February 16 and submitted for public comment.
As regards the content of this decree, the communique of the Council of Ministers of 30 March only mentions that “it changes several legal regimes in the field of housing construction, allowing from the very beginning to strengthen the conditions for achieving the intended goals.” , while implementing the Recovery and Resilience Plan (PRR).”
The President of the Republic has publicly expressed reservations about the government’s housing package, challenging in particular the intention to pass a law on mandatory vacant rentals.
