A court in Coimbra this Friday sentenced a 22-year-old to four years in prison with a suspended sentence for abusing an 18-year-old girl on New Year’s Eve 2021-22 in Figueira da Foz.
The public ministry accused the young man of abusing a 17-year-old girl (at the time of the events) in the early morning of January 1, 2019, and another 18-year-old girl on New Year’s Eve from 2021 to 2021. 2022, both situations in Figueira from Foz.
The Court of Coimbra decided to acquit the defendant of one of the crimes he was accused of, but emphasized that he had no doubts about the crime committed on the night of December 31, 2021 to January 1, 2022, Judge Miguel Veiga said. who presided over the collective during the reading of the verdict, which took place this Friday afternoon.
The defendant was sentenced to four years of suspended liberty for the practice of sexual violence against a person unable to resist (the victim was asleep when he mocked her), and to pay the victim 15,000 euros.
The suspension of imprisonment depends on the mode of trial and the social reintegration plan, as well as the payment of 15 thousand euros during the first three years of the suspension of the execution of the sentence (which will be suspended for a maximum period of five years). , said the judge.
Miguel Veiga considered that the defendant was “skillful” in his answers, but realized that “the second situation is quite obvious.”
According to the prosecution, in this second situation, the young man would have insulted the victim when she was sleeping on the bed after taking alcoholic beverages, waking up during the bullying.
The judge noted that the defendant took advantage of the moment when everyone left the house, including the owner of the house, evaluating both the statements of the victim and her ex-boyfriend, who realized what condition the girl would be in after the abuse of the accused.
“The court was convinced that, in fact, what is at stake here should be taken for granted,” he stressed.
With regard to the first situation, Miguel Veiga expressed several doubts in the victim’s testimony, not taking for granted the “facts contained in the accusation”, namely the ill-treatment, suggesting only that a “full sexual intercourse” had taken place.
The judge who presided over the bench said the statements, more than two years after the facts, were “fragile” and “very weak”.
“The victim is not very aware of what happened. Obviously, something happened,” Miguel Veiga said, pointing to “weird aspects,” such as the fact that the victim continued to “message on Facebook like everything was fine.” after the alleged violence.
“Is it incompatible? It’s not incompatible. But amid all this cloudiness, this behavior is not very common,” the judge said.
