Parliament rejects letters to extend statute of limitations for economic crimes

The Assembly of the Republic this Friday rejected two bills from PAN and Chega to increase the statute of limitations for certain economic and financial crimes, which received support only from their respective supporters.

The PAN bill was defeated in a vote against PS, PSD, the Liberal Initiative and abstentions from Chega, PCP, Bloco de Esquerda and Livre. The Chega Diploma was opposed by PS, PSD, PCP, Bloco de Esquerda e Livre, as well as proposals from the Liberal Initiative and PAN.

The PAN initiative has proposed extending the statute of limitations for document forgery and tax offenses by providing new grounds for suspending or interrupting the statute of limitations in criminal cases.

Chega intended to change the statute of limitations for sexual offenses against minors and the cumulative crimes of corruption.

On Wednesday, PS and PSD already expressed their opposition to the diplomas, arguing that some of these deadlines have already been duly extended with the approval of the National Anti-Corruption Strategy, which PAN leader Ines de Souza Real considers insufficient, while Andre Ventura from Chega believed that “the statute of limitations is outdated.”

From the PS, Claudia Santos defended that “more effective criminal justice is needed”, and not investigations that last 15 years, during which the “freshness of evidence” and “material truth” are lost. PSD’s Monica Quintela realized that “it is unacceptable to extend the statute of limitations”.

Patricia Gil Vas (Illinois), Joana Mortagua (Belgium), Alma Rivera (PKP) and Ruy Tavares (Livre), among others, also mentioned in their speeches that simply extending the statute of limitations does not solve the problem of criminal justice. with regard to “white-collar crime”, they all agree on the need to provide the judicial police, the prosecutor’s office and the courts with the human and material resources necessary to improve the effectiveness of justice in the investigation of criminal offences.
