The Supreme Court refused to commute the sentence of a father who hit another man for groping his underage daughter’s breasts. Magistrates ruled out application of mitigating circumstance of passionate act advances La Vanguard.
The facts date back to October 2016, when a man approached a minor and her mother in the middle of the street and told them, “Good girls, I’m fucking.” Then the man “touched the girl’s left breast with his open palm” without her consent. The father punched the man in the face, causing him to fall to the ground with a minor head injury and broken ribs.
The court of first instance that heard the case sentenced the man who molested the minor to a fine of 3,600 euros and imposed a restraining order, as well as a ban on contact with the victim. The father was sentenced to a fine of 1,080 euros for causing bodily harm.
Both appealed to the provincial court of Madrid, which agreed to change the father’s sentence and add compensation.
Dissatisfied with the decision, both defendants appealed to the Supreme Court, which rejected both claims.
