The President of the Republic, Marcelo Rebelo de Sousa, published this Monday a parliamentary decree that restructures the Single Contact Point for International Police Cooperation, in accordance with the decision of the Constitutional Court.
The return of the decree to Parliament was announced in a note on the official website of the Presidium of the Republic on the Internet shortly after the Constitutional Court announced that it had decided not to rule on its unconstitutionality.
Marcelo Rebelo de Sousa states that with the decision of the judges “in the sense of unconstitutionality” of the decree, “doubts about the legal certainty of the approved regime, which were at the origin of a wide division in the vote in Parliament, are thus overcome.”
“Following the decision of the court, the President of the Republic, who appreciates the speed of the decision, decided, in accordance with constitutional conditions, to promulgate the decree in question,” the same note adds.
Based on a government proposal, the decree to restructure the single point of contact for international police cooperation was approved by the Assembly of the Republic in a final global vote on October 27, with votes for PS and against all. other parties: SDP, Chega, Liberal Initiative, PKP, BE, PAN and Livre.
The head of state announced that this decree was sent to the Constitutional Court on November 17, “considering that it is about fundamental rights that caused a split in parliament for political and constitutional reasons” and “for the purpose of legal certainty.”
In a letter to the Constitutional Court, Marcelo Rebelo de Sousa asked for a review of the constitutionality of the provisions of this decree, which amends article 12 of the Law on the Organization of Criminal Investigations and article 16 of the Law on Internal Security, for violations of the “principle of separation of powers” and “autonomy prosecutor’s office in the implementation of criminal actions”, guaranteed by the Constitution.
