The Constitutional Court rejected the third application for registration of the Nova Direita movement as a political party

The Constitutional Court (CC) rejected the application to register Ossanda Libera’s New Right movement as a political party, finding that the draft charter did not meet the requirements of the law.

The VC “does not consider the legality of the draft charter to be verifiable and decides to reject the request for registration in the court’s own registry of a political party with the name “NOVA DIREITA” and the abbreviation ND,” the statement said. The decision of December 13 was published on the court’s website.

The movement, led by Ossanda Lieber (who was vice-president of the now-defunct Alliance party), has already requested registration as a political party twice this year, but the TC rejected it due to a lack of subscribers (minimum 7,500 signatures). or because invalid signatures were discovered.

Among other aspects that violate the law on political parties, in the third request the CU indicates that the submitted draft charters do not guarantee the independence and impartiality of the jurisdictional body when considering decisions on sanctions against activists.

The TC also emphasized the lack of a specific deadline for the courts to make decisions.

In the ruling, the judges also pointed out an omission in the draft charter, warning that the law requires that the party charter contain rules that explicitly ensure balanced participation of women and men in political activities and guarantee non-discrimination on the basis of gender in the party sphere. access to internal organs and applications.

This is stated in a statement published on the Mart social network.

“Nova Direita is determined to overcome this obstacle and ensure that its ideas and values are represented in the next elections,” the leader emphasizes, saying that she is “confident that justice will prevail.”

Ossanda Lieber also believes that this decision of the TC “represents a serious setback for the New Direita, which seeks to present a new political vision and defend the conservative values and principles that it considers important for the country.”

“Nova Direita believes that this refusal is a form of discrimination that limits the party’s ability to participate in political debate and represent its constituents,” criticizes the movement’s leader, accusing judges Palacio Ratton of discrimination.” in the way the process was carried out and in the arguments presented, which were never required of any political party in Portugal.”
