This opinion was debated and voted on behind closed doors, with the chairman of the commission, socialist Alexandra Leitao, eventually stating that it failed due to votes against the PS, abstentions from the SDP, and votes in favor. from Chega.
Last week, having previously agreed not to vote on the original opinion, Chega announced that she would ask the Commission on Transparency and the Statute of Deputies for a new assessment of the situation of Jamila Madeira, who has accumulated functions in parliament and in the REN. .
In an application dismissed on Tuesday, Chega asked the commission to decide “whether or not MP Jamila Madeira is compatible with the position of deputy with a part-time consultant job at REN. Services”.
“And, if so, what are the consequences of this incompatibility, according to the provisions of the Statute of Deputies and other applicable legislation, given that the said deputy was in the said position from 2015 until the end of 2022,” the sent document says. to Lusa by the side.
On January 17, the Transparency Commission clarified that the process of investigating the interference situation with Jamila Madeira was completed a week earlier due to the fact that the Socialist MP has been exclusively in Parliament since the 1st of this month.
According to Alexandra Leitao, explained that day, the law does not provide for the replacement of funds received in cases such as Jamila Madeira.
“From the moment the lady in question informs us that from January 1, 2023, she will be exceptional, that is, only here in Parliament, in fact, even if the opinion was subsequently approved, there was no other. consequence, because the consequence would be to inform her of the termination of the situation, of which she has already informed us that “motu proprio” [de livre vontade] I was going to do it,” the chairman of the commission defended.
Asked then if the case would be closed, Alexandra Leitao was adamant: “From the side of the Transparency Commission, with the data we have today, yes.”
Regarding the postponement of the vote on the draft opinion on December 20, Alexandra Leitao indicated that the issue had been raised “initially by the PS parliamentary group”, but the decision to postpone was taken “by agreement in the commission” after news indicating that this postponement would be potestative .
On Tuesday, during a session open to journalists, the chairman of the commission referred specifically to the minutes of that day’s session, which would have caused “some oddity” when parliamentary services returned to listen to the audio of that meeting.
For this reason, the deputies will be sent a correction of the minutes of that day, which “will be a strict transcription of the audio recording”, precisely at the time of the postponement of the vote on the draft opinion prepared by the PSD that indicated an “obstacle in the cumulative implementation” of the two positions, but on which no was put to the vote.
Pointing out that “there is another abstract understanding of what a potestative is” for the delay, Alexandra Leitao explained that when she saw no obstacles from any of the deputies, “she realized” that there was “an agreement, even if not by voting.
After this incident, the chairman of the 14th commission decided that from now on “to put to the vote all requests for postponement”, a decision that evoked the approval of the deputies and was approved unanimously.
