According to an order published this Thursday in Diário da República, the commission created by the government to simplify and speed up tax processes and procedures will have six months to submit proposals to the government, with the possibility of an extension of three more.
The Commission for the Review of the Tax Process and Procedures and Taxpayer Guarantees will be chaired by Rogerio Fernandes Ferreira, former Secretary of State for Tax Affairs in the government led by António Guterres, and will include 11 other members, including three judges-advisers and two judges-advisers.
According to a diploma from the office of Finance Minister Joaquim Miranda Sarmento, this commission must carry out a “deep and comprehensive assessment” of the Code of Tax Processes and Procedures in light of what is provided for in the government’s program for the revision of tax justice, as well as the anti-corruption program recently approved by the Council of Ministers.
The Anti-Corruption Agenda sets out, in relation to promoting the acceleration of processes in tax jurisdictions, the obligation to “implement the results of the working group in the area of administrative and tax justice, applying legislative solutions aimed at combating corruption permeability”.
To do this, he must propose “the necessary legislative changes” aimed at achieving these goals.
The diploma also justifies the creation of the new commission, pointing out the importance of tax disputes “for defining tax legal relations that are established between the state and taxpayers and which sometimes intersect with criminal jurisdiction, forming the procedural code and the tax process.”
