Dog owner who killed pinscher and bit owner convicted

The Court of Appeal of Porto (TRP) has sentenced the owner of a dog that killed a Pinscher and attacked a woman walking the animal in Maia, Porto District, to pay a fine of 450 euros.

The February 15 TRP decision, consulted by Lusa this Wednesday, granted the Department of State’s (MOD) appeal, overturning the first instance verdict that acquitted the defendant of the crime against physical integrity for negligence, of which he was charged.

Judge Maya considered that the facts set forth in the charge “constitute not a crime, but an administrative offense”, referring the case to the General Directorate of Food and Veterinary Medicine, which is responsible for deciding on punishment. .

However, the deputy appealed this decision to the TRP, which sentenced the defendant to a fine of 90 days at the rate of 5 euros per day for a total of 450 euros for a crime against physical integrity by negligence.

In addition to the fine, the defendant will also have to pay compensation in the amount of more than 23 thousand euros to the woman bitten while walking the attacked dog and the owner of the animal.

The case took place on July 19, 2019, at around 3:15 p.m., on Rua da Maya in the Porto district, when the defendant was walking his mixed breed dog without a leash and a muzzle.

When meeting with a dog that was passing by the offended, the Pinscher breed, the defendant’s animal grabbed him by the trunk, shook him, threw him into the air and, after he was already lying on the ground, bit him several times. eventually killing him.

The dog also attacked the victim, biting her arm, hand and leg as she tried to defend her dog from the attack.

It was also proved that earlier the defendant’s dog had already bitten the victim’s sister, as well as their mother.

The decision states that despite knowing “the specific danger that his dog poses to the physical integrity of third parties”, the defendant allowed the animal to move on a public road without proper restraints, “without taking care and proper measures the precautions required.” him and what he was capable of.”
