The TikTok app is the subject of two lawsuits in Portugal, brought by the non-governmental organization Ius Omnibus, seeking to convict the social network for illegal activities and seek compensation that could amount to 1.12 billion euros.
The lawsuits, which were filed on Tuesday in Lisbon’s Central Civil Court, involve users under the age of 13, who are being sought global compensation of up to 450 million euros by the consumer protection association, and TikTok users over that age. of 13, whose actions include a payment to these users totaling 670 million euros.
The essence of the campaign, aimed at children under 13, is to demonstrate that the platform, owned by the Chinese group ByteDance, does not apply the necessary mechanisms to prevent registration and use by children without the permission of parents or legal representatives. The promotion, which is aimed at users over the age of 13, uses “misleading commercial practices” and an “opaque privacy policy.”
Highlighting that Portugal is the second European country after the Netherlands where lawsuits are being brought against TikTok for alleged illegal and abusive activities, Ius Omnibus, which estimates a total of 3.5 million users in the country, highlights the risks associated with protecting personal data and, before above all, in the protection of children and youth, who have a significant weight in the world of users.
“The aim of the two lawsuits now filed is to prevent the platform from persisting in the many illegal activities whereby TikTok does not respect privacy and collects and uses the personal and sensitive data of its users without proper authorization, in violation of its legal obligations,” adds the organization, led by General Secretary Daniela Antao, who will present the main directions of the initiative this Wednesday in Lisbon.
TikTok is subject to restrictions in several countries such as the United States, Australia, United Kingdom, Canada, New Zealand, France and the Netherlands, as well as European Union institutions.
