The Ministry of Justice (DOJ) said on Friday that the technical problems that prevented the distribution of cases in some administrative courts on Thursday, the first day of the new rules, have been resolved.
“Specific technical problems, registered on the first day of the new rules coming into force, were overcome with the help of teams from the Institute for Financial Management and Equipment of Justice (IGFEJ) and the Directorate General of the Administration of Justice (DGAJ), who supported the judges who presided over the meetings. Thus, managed to allocate all the cases today, the distribution of which was not successfully completed yesterday [quinta-feira]”, reads a statement released by MJ this Friday.
According to the guardianship, the distribution occurred “at the full rate in all jurisdictions.”
“During the day, 6684 cases were distributed concerning 377 secretaries of courts of the first and higher instances. 155 cases have been distributed to the administrative and tax courts, ”the balance sheet published by the Ministry of Justice says. .
The Union of Judges of the Prosecutor’s Office (PSJP) has already stated that the problems registered on the first day of distribution in accordance with the new regulation gave rise to prosecutors’ fears, reiterating their concern about the need for their presence in the draws to be able to mean breaks in trials, interrogations and diligence.
In view of what he sees as a waste of time and money, the SMMP president suggests that judges only be present “when the computer system is down and manual allocation is resorted to.”
The union asked for an audience with Justice Minister Catarina Sarmento and Castro, waiting “almost two weeks” for an answer.
In a statement late Thursday, the first day of the new distribution model, the Justice Department said “technical problems” prevented the distribution of cases under the new rules in seven of the 17 first instance courts in the administrative and tax area.
The laws changing the rules of procedural distribution were approved by Parliament in 2021 and have been waiting for more than a year for a regulation to regulate them, which was published in the Diário da República at the end of March and comes into force on Thursday.
The concern expressed since then by the judiciary, the judiciary and the public prosecutor’s office is related to the new obligation “to gather daily in all places where the distribution takes place, a group of bailiffs to assist in the act of distribution, which has hitherto distributed, in most cases any interference person, and draw up a report to which the result of the distribution is attached,” as explained in the decree of the Ministry of Justice.
