E-Redes paid the farmer more than 46 thousand euros for the loss of crops

Electricity distribution company E-Redes was ordered to compensate €46,680 plus interest to a farmer who lost production of 12 tonnes of animal feed due to “constant changes in the energy supplied”, with “voltage surges” and “interruptions”.

The court heard that crops on a 16-hectare plot of land in Almograve, Odemira, “withered and yielded nothing” due to a breakdown in the irrigation system during a “critical growth period”. The irrigation axis “difficulty starting or did not water with normal force and quantity,” even eventually burning out the “progressive starter.”

The irrigation pump exploded due to electrical voltage fluctuations, which ranged from “230 to 160 volts.” The farmer appealed to the Beja court, which ruled in favor, as did the Court of Appeal of Évora, where E-Redes appealed.

The Oct. 10 ruling said “the company is directly responsible” for “disruptions in the supply” of energy, and added that “the destructive event resulting from voltage peaks and power outages arose as adequate exposure to risks inherent in transportation and delivery, which means that his obligation to compensate the “farmer” for the damage suffered cannot be challenged.”
