The National Democratic Alternative (ADN) filed a lawsuit this Wednesday with the Judicial Court of Madeira’s Comarca to annul Chega’s candidacy in the Sept. 24 elections in order to avoid an “electoral catastrophe,” the party said.
In a published note, ADN indicates that this measure is aimed at preventing “admission to the regional elections in Madeira” of the candidacy of Chega, led by Miguel Castro.
The party, by the way, refers to the decision of the Constitutional Court, which confirmed that “all discussions and decisions after the Fifth Congress of the political party Chega” are invalid.
These solutions, ADN emphasizes, “include the ability to select and nominate lists and candidates running for the 2023 Madeira regional elections.”
“Therefore, we have no doubt that Chega will not be able to run effectively in these regional elections,” ADN leaders say.
In his opinion, it is unacceptable “that the decision of the plenum of the Constitutional Court, the supreme body of this court, which is not subject to appeal, is not fully implemented in its exact terms, since no one can be above the law.”
The ADN does not recognize that a party like Chega, with “huge financial subsidies of millions of euros” and the ability to “employ huge staff to easily solve problems of this kind”, wants to “be above the law”. and choose the position of constant “victimization”.
As for the National Democratic Alternative, Chega must make “an act of remorse and admit his inability or sheer incompetence in such linear matters as the organization and internal functioning of his own party.”
Without these actions, the party believes, Madeira could face the risk of regional elections being subsequently annulled, leading to repeat suffrage and increased spending, as well as a potential “institutional crisis in the absence of a government.” Legislatively established regional position can lead to detrimental consequences for the region and its population.”
“This situation of possible electoral disaster and consequent high economic and social damage should be more than enough reason for Chega not to put the Autonomous Region of Madeira and its people in immediate danger,” they argue.
The ADN claims that Chega should withdraw or annul his candidacy and “settle in his headquarters the lawlessness that has been repeatedly committed by the party organs without harming anyone.”
The silence of other parties on this issue has also been criticized, interpreted as “proof that everyone, including Cheg’s party, is part of this corrupt system that has been operating in the country for decades.”
The judge of the Judicial Court of Funchal has 48 hours to decide on this case.
On Tuesday, a judicial court accepted 13 nominees submitted in regional elections, rejecting an application challenging Chega’s legitimacy, according to Madeira’s president, Komarchi.
Filipe Câmara added that another “application filed against Chega’s candidacy was completely rejected due to the lack of legitimacy of the applicant, the absence of any reports from the Constitutional Court about this party and the absence of any procedural violations.”
At a press conference this Wednesday, when asked about the possibility that the party’s candidacy was under threat, Chegi’s national leader Andre Ventura said that “if the Constitutional Court decides that the list cannot go to the polls, it will be a democracy that is put on the map.”
In a decision published on its website on Thursday, the Constitutional Court upheld the decision to invalidate the call to the V Cheg Convention and noted that the validity of the actions taken at the Magna meeting “is a matter that is outside the scope” of this process.
This confirmed the decision of July 11 to annul the congress, as well as the approval of the electoral and working regulations of this large meeting, which took place from January 27 to 29 in Santarém.
