On Tuesday, the European Court of Human Rights (ECtHR) ruled against Madeleine McCann’s parents, Kate and Jerry, arguing that Portugal had given the parents a fair hearing in their libel dispute against a former Portuguese police officer.
For Kate and Gerry McCann, the words of the head of the investigation into the disappearance of their three-year-old daughter represented a violation of their right to respect for privacy and the right to be presumed innocent.
At the same time, they pointed out to the Portuguese authorities the alleged lack of balance between the various interests at stake, namely between their right to privacy and the right of the warring parties to freedom of expression.
