A petition has been filed with Pakistan’s Supreme Court demanding the resignation of the country’s president, Arif Alvi, Geo News reported on November 25, citing the text of the petition but without identifying the petitioners.
“The President of Pakistan, Mr. Arif Alvi, is not acting according to his duties, but he is biased […] “He abuses his power and continually violates the constitution of the Islamic Republic of Pakistan with his words and behavior.”says the text of the statement.
The petitioners cited as an example the high-profile scandal of the resignation of Pakistan’s Parliament in 2022, when the president approved the appointment of then Prime Minister Imran Khan. The Supreme Court subsequently overturned the president’s decision, calling it unconstitutional, and restored parliament’s powers. However, both President Alvi and Prime Minister Imran Khan submitted to the Supreme Court’s decision.
On this basis, it is argued that President Alvi (who is a member of Imran Khan’s opposition Justice Movement Party) acted as a representative of the party and not as president.
Recall that on September 8, 2023, the term of the current president expired, however, since Pakistan currently does not have a legally elected parliament or government, Alvi proposed to use article 44 of the constitution, according to which he must remain in the position until the official appointment of a successor approved by parliament.
It may be noted that the current president and current Chief Justice of the Supreme Court, Qazi Faiz Isa, had a “negative” incident in the recent past when Alvi filed a presidential writ petition against Justice Isa (who was not yet president at that time). time) before the Supreme Judicial Chamber requesting dismissal for inappropriate conduct.
As a result, the investigation against Isa did not end until 2023, and the new government dropped the charges against him, and only after Judge Isa entered into open conflict with the president of the Supreme Court, Umar Ata Bandial, who supported de facto the Government.
At the same time, the Pakistan Muslim League-Nawaz (PML-N), which was behind all these dramatic events, starting with the resignation of Imran Khan in April 2022, also committed repeated violations of the Constitution, and its government even openly. ignored the Supreme Court’s decision in the Punjab province election case. However, this act of disobedience had no significant consequences for the government.
