Lawyer Astrid Wagner said the move paves the way for the conditional release of Josef Fritzl, now 88 and suffering from dementia.

The man known as the “Monster of Amstetten” had seven children with his daughter Elisabeth during the years he kept her imprisoned in the basement of his home. In 2009, he was sentenced to life in prison for the kidnapping, rape, incest, enslavement and negligent homicide of one of his children.

Wagner argues that Fritzl truly regrets his crimes and that “since he is no longer a danger,” he should be able to leave prison and go to a nursing home where he will be treated with “human dignity.”

Josef Fritzl’s crimes became public knowledge when one of the children he had with Elisabeth became seriously ill and had to be taken to hospital.
