Despite the lack of coronavirus vaccination, two employees of the state government of Baden-Württemberg will receive compensation for loss of income during the coronavirus quarantine, the Administrative Court of the state of Baden-Württemberg has ruled, reports the German radio station Südwestrundfunk.
The Baden-Württemberg Administrative Court (VGH) has confirmed the correctness of two rulings of the Stuttgart Administrative Court and the Karlsruhe Administrative Court according to which the Land of Baden-Württemberg must pay compensation to two unvaccinated employees for the loss of income caused by the coronavirus quarantine.
“The decisions are not yet legally binding; the state can still appeal. Subsequently, the cases will be examined by the Federal Administrative Court.”notes the publication.
Broadcaster Südwestrundfunk described the circumstances of claims for loss of income during the COVID-19 quarantine period. The employer of one of the employees and the individual insurance broker filed a lawsuit.
“Both were not or were not fully vaccinated. “They demanded that the State recover several hundred euros of lost income due to the quarantine.”says the message.
Both employees were in official quarantine for several days after each was diagnosed with COVID-19 infection. The State refused to compensate for the loss of income.
“Under the Infection Protection Act, no compensation is paid to those who could avoid quarantine by getting vaccinated.”explains the German broadcaster.
However, the VGH noted that the vaccines approved at the time only provided 70 percent protection against infection. While to exclude the assumption of loss of income, a degree of effectiveness of at least 90% is required, the court ruled.
“Therefore, despite the lack of vaccination, there was a claim for compensation for loss of income.”notes Südwestrundfunk.
