The newspaper El Periódico has gained access to a 24-page appeal filed last Monday by Dani Alves’ lawyer who intends to overturn the January 20 pretrial detention ordered by the judge.
A Brazilian international is accused of assaulting and raping a 23-year-old girl at a club in Barcelona, but lawyer Cristobal Martell casts doubt on the victim’s account based on images of the club in his appeal, alleging that the woman deliberately entered the club. the bathroom is behind the player, and he does not need to skip it or open the door.
According to lawyer Dani Alves, the victim’s testimony “appears to be inconsistent and inaccurate” and may be due to “narrative misrepresentation.”

The defense explains that the footage shows Dani Alves entering the bathroom alone. “We see Dani Alves walking to the left and entering the bathroom door (…) two minutes later the applicant, after talking for a while with her two friends and an employee, comes to that door and enters without Dani. Alves lets her through or opens the door for her. The images speak for themselves.”
Regarding the player’s first statement, which began by denying any sexual relationship with a young woman at the disco, the lawyer explained: “The initial refusal finds a natural and elementary explanation in the desire to keep the woman and children from behavior that is unacceptable. may not be suitable for intercourse.”
