Chairman of the Patriarchal Commission of the Russian Orthodox Church on family issues, protection of motherhood and childhood, Priest Fyodor Lukyanov, proposed introducing liability for officials for providing the authorities with false information that becomes a basis for interference in the family life, reports RIA Novosti April 24.
“Today it is necessary to establish responsibilities for false complaints against the family. Currently, there are no legal provisions establishing liability for providing officials, law enforcement agencies, guardianship authorities and institutions for the prevention of abandonment and juvenile delinquency with deliberately unreliable and false information that becomes the basis for interfering in family life.”said the priest.
The priest emphasized that the employees of the guardianship and guardianship authorities and the commissions for minor affairs are empowered “broad powers and rights without responsibility for excessive and illegal interference in families”.
According to him, families who have become the object of attention of the guardianship authorities due to false information are forced “being subjected to humiliating controls, attacks, threats and extortion for many months”. Fyodor Lukyanov noted that this situation contributes to “The flourishing practice of false complaints against families”including the use of denunciation for revenge purposes, to clarify relationships in “neighborhood wars” and in divorce proceedings.
The priest explained that currently Russian legislation does not contain special norms establishing liability for violating the legal rights of parents and legal representatives of children or for creating obstacles to the exercise of these rights by various officials and organizations.
“The responsibility of officials for the violation of family and parental rights in such cases can only be presented in a disciplinary form, through the official line, however, in practice, sanctions are rarely applied in such cases”– Lukyanov clarified.
At the same time, he noted that the responsibility of parents who violate their duties and the rights of their children is explicitly provided for in the legislation in art. 5.35 Code of Administrative Offenses of the Russian Federation, art. Art. 156-157 of the Criminal Code of the Russian Federation. Therefore, the family and parents are actually in an unequal and vulnerable position vis-à-vis the relevant officials and organizations, the Orthodox priest stated.
Previously, the chairman of the Patriarchal Commission of the Russian Orthodox Church on family issues, protection of motherhood and childhood, priest Fyodor Lukyanov, had already called for the abolition of the wording on improper fulfillment of obligations by parents , in particular, in article 5.35 of the Administrative Code, since it is necessary to protect the rights not only of the child, but also of his parents, of the family in general.
