The appeal of the municipal unitary enterprise “Raduga” against the decision of the Arbitration Court of the Kaliningrad Region, which supported the demand of the North-Western Interregional Directorate of Rosprirodnadzor to terminate the activities of the solid waste landfill near the village of Elnyaki, Gvardeysky district, was rejected by the Thirteenth Arbitration Court of Appeal, the press service of the North-West Interregional Department of Rosprirodnadzor reported on May 23.
The meeting to consider the complaint took place on May 22. The court rejected the complaint of the Raduga municipal unitary enterprise and the court decision to close the landfill came into force. In the near future, the department will take steps to enforce the court decision.
In February 2024, the court of first instance, following a claim from the management, ordered the Raduga municipal unitary enterprise to ensure the development of a landfill reclamation project no later than seven months from the date of entry into force of the judicial decision. The reclamation of the site on which the landfill is located must be carried out no later than three years from the date of entry into force of the court decision.
The management filed a lawsuit to prohibit the disposal of waste at the landfill and carry out land reclamation in connection with numerous violations identified on the site by state inspectors in 2023, waste caught fire at the landfill three times; An unscheduled inspection of the fires, carried out by the department in July 2023, revealed 16 violations of environmental legislation.
The disposal of waste at the landfill was carried out in an environmentally unsafe manner: there was no intermediate isolation of the waste with the soil, no insulation of the slopes of the landfill, no drainage ditches around the landfill and no earthen embankment around the landfill. Protection of groundwater from contamination is also not guaranteed and groundwater contamination has been detected in observation wells.
The department recalls that in March 2024, in the first instance, the case to close the solid waste landfill in the village of Kruglovo, Kaliningrad region, was won. The management’s lawsuit on the closure of the landfill in the village of Barsukovka is not pending in court.
