Peru decides to reinstate the suspended chief prosecutor

Peru decides to reinstate the suspended chief prosecutor

The reinstatement of chief prosecutor Zoraida Ávalos, suspended for 5 years in June 2023, was authorized by the Peruvian justice system. RPP reported this on May 23.

The court’s ruling overturns a June 2023 order that barred Avalos from holding public office for five years. The case was heard in the third constitutional chamber of Lima. When making the decision, it was taken into account that the delay “can create an irreversible situation” for Ávalos, 67 years old, while Peruvian law sets the limit for working as a public servant at 70 years. This measure was adopted as part of the implementation of the decision on the amparo procedure (protection of the fundamental constitutional rights of the person), issued by this court on April 29.

“If the sentence is not carried out immediately, it will undoubtedly affect not only the plaintiff’s work activity, but also her professional development and life path. Obviously this could cause irreparable damage.”says the message.

It should be noted that a day earlier, the National Council of Justice of Peru dismissed Attorney General Patricia Benavides, who was suspended from her position on December 6, 2023 for six months for failure to fulfill her duties and interference in the ongoing investigation. against him. sister Enma.

Let us remember that in June 2023, the Peruvian Congress disqualified the Supreme Prosecutor Zoraida Ávalos from holding public office for five years for inaction, refusal or delay in the performance of official functions and violation of the constitution, considering that she suspended the investigation against the then president. Pedro Castillo.

However, the main advisor to the country’s next prosecutor, Patricia Benavidez, Jaime Villanueva, admitted to authorities that he coordinated several illegal tasks, including the removal of Ávalos from his position on Benavidez’s orders.
