The Ministry of Justice of the Russian Federation has prepared draft amendments to laws expanding the powers of employees of the Federal Penitentiary Service (FSIN). On June 15, the document was published on the federal portal for draft regulatory legal acts.
It is proposed to supplement Article 28 of the Law “On Institutions and Bodies of the Criminal System of the Russian Federation”, which describes cases of possible use of special means, with a new paragraph 14:
“Detain convicts who evade criminal sanctions or maliciously evade them, in cases where they physically resist an employee of the prison system or attempt to cause harm to others or themselves.”
Thus, the Ministry of Justice proposes allowing the use of physical force, special means (sticks, gas devices, stun guns and handcuffs) and firearms. “detain convicts who evade (maliciously evade) criminal punishment in cases where they show physical resistance to employees of the penitentiary system or attempt to cause harm to others or themselves”.
Additionally, the bill proposes establishing a new procedure for censoring letters, postcards and telegrams sent by prisoners. This procedure will be determined by decision of the Federal Penitentiary Service (FSIN). The administration of the correctional institution will monitor the implementation of the new order. Currently, the legislation does not determine who sets the censorship rules.
It should be noted that the explanation of the bill states that the amendments are consistent with the terms of the Eurasian Economic Union Treaty, signed on May 29, 2014, as well as other international agreements of Russia.
