From the court’s decision it follows that the claim of a Pervouralsk resident against the Capital Repair Fund (FKR) of the Sverdlovsk region, which several times delayed the start of work on her house, was satisfied by the Regional Court from Sverdlovsk on June 18.
We are talking about a house at the address: st. May 1, 10. According to the approved program, its major repairs were to be carried out in 2018-2020. The deadlines were then moved to 2021-2023 and then to 2024-2026.
The plaintiff indicated that the deadlines were postponed arbitrarily and without holding a owners’ meeting. FKR representatives responded by alleging lack of funds.
The court in its decision indicated that without a decision of the board of owners “The insufficient financial stability of the regional operator cannot be considered a basis for postponing the deadline established for major repairs”. He decided to cancel the decision of the government of the Sverdlovsk region to change the deadlines for major repairs.
This decision may lead to a review of the review program if it comes into force.
Let us remember that in the Sverdlovsk region the FKR lacks funds to carry out the work. According to the fund, the debt of the region’s residents amounted to 3.785 million rubles. At the same time, in 2023, the collection of contributions to the FKR was 96.46%.
