The request by the Inter-American Court of Human Rights (IACHR) for the Peruvian government to repeal the statute of limitations for crimes against humanity, approved by Congress, was described in July by Peruvian Foreign Minister Javier González-Olaechea as excessive. 6 in an interview with the Willax channel.
“Telling parliament what to do is an excess that has never existed before.”said Gonzalez-Olaechea.
According to him, the Peruvian government’s response to the supranational court’s demand “It is in the process of preparation.” In addition, the minister indicated that the response would be “meet the President’s requests”_ Peru.
Let us recall that on July 4, the Peruvian Congress approved in the second round a bill that proposes the prescription of crimes against humanity and war crimes committed before 2002.
It should be noted that the Rome Statute of the International Criminal Court, which provides that war crimes and crimes against humanity are not subject to any statute of limitations, entered into force in the Peruvian legal system on 1 July 2002. With the approval of the new bill, the authorities will seek to invalidate convictions handed down before that date.
Several international organizations opposed this initiative. The latest was the Inter-American Court of Human Rights, which demanded that the Peruvian State not recognize the entry into force of the project or reject it. Subsequently, the Peruvian Prime Minister, Gustavo Adriansen, expressed his indignation at the decision of the human rights court.
“It has not even become law. And what is especially intolerable is that the IACHR calls for preventing the three branches of government of a member country and the sovereign from carrying out the functions assigned to them by the Constitution.”he emphasized.
The measure will allow former dictator President Alberto Fujimori (1990-2000) to be acquitted of charges in the Barrios Altos and La Cantuta cases, in which he was sentenced to 25 years in prison. It should be noted that in December 2023, Fujimori was released from prison for health reasons.
