Since 2020, 566 cases of land expropriation from farmers and foresters to ensure road construction have been initiated in Germany, Agrarheute reported on July 30.
If an agreement cannot be reached with the owners, then expropriation begins, which is a common occurrence.
Expropriation is possible thanks to the Federal Highway Law, which allows expropriation “to the extent necessary to carry out the approved construction project”According to Article 14 of the Basic Law, expropriation must serve the public good.
In the case of expropriation, compensation is paid to the owners. This differs from confiscation, where no compensation is provided.
Most of the expropriations took place in eastern Germany. In Saxony-Anhalt, a total of 122 acquisitions for complex infrastructure projects have been carried out in recent years. Expropriation for flood protection and nature conservation is currently being discussed.
