The Cascais Civil Court has ruled that former Grupo Espirito Santo (GES) president Ricardo Salgado cannot testify in court because he has been diagnosed with Alzheimer’s disease.
This is the position taken in a ruling in a state civil case against a former banker and his wife following a €3.7 million fine imposed by the Competition, Regulation and Supervision Court. In this case, the Public Prosecutor’s Office (MP) required the defendants to give partial statements – a means of proof aimed at judicial recognition.
“The defendant’s inability to appear in court due to illness to give evidence is confirmed not so much for physical reasons, since his travel and presence at the court hearing is possible – even if he needs the help of third parties who will help you financially (…) -, but rather from the point of view of the usefulness and purpose of this means of evidence,” one can read in the July ruling of the Cascais court.
