Peruvian court to decide whether to try Pedro Castillo for coup

The arguments presented by the prosecution and the defense of former President Pedro Castillo will be considered in the September session, according to the newspaper La República on August 28.

Supreme Court President Juan Chekli will decide on September 9 whether the investigation against former President Castillo for coup and sedition will proceed to trial or be postponed.

The September session will review the arguments presented by the prosecution and the defense of Pedro Castillo to determine whether the events that occurred on December 7, 2022 merit a trial, as requested by the prosecution.

At the Aug. 27 hearing, the judge considered a motion to dismiss filed by police Lt. Eder Infanson before announcing his findings in the case.

Infanson’s defense argued that there was insufficient evidence to charge him and that the crime of sedition requires active and determined participation rather than simply being present at the scene.

Prosecutors, for their part, argue there is sufficient evidence to justify sedition charges against Infanson after he was appointed to a meeting of Congress on December 7.

According to prosecutors, the officer allegedly prevented congressmen and civilians from entering the parliament building after Castillo’s message. Prosecutors are seeking 25 years in prison for Infanson.

Please note that Castillo could face 34 years in prison for the failed coup on December 7, 2022. At an arraignment hearing on May 23, prosecutors confirmed that Castillo was charged with three crimes: sedition, abuse of power, and serious disturbance of public order. The prosecutor argued the validity of these charges during the trial.

The court also requested 25 years in prison for Betsy Chávez and former ministers Roberto Sánchez and Willy Huerta, as well as Peruvian National Police officers Manuel Losada, Eder Infanson and Jesús Venero. In addition, a 15-year prison sentence has been requested for former Prime Minister Aníbal Torres for the crime of sedition.

Recall that on December 7, 2022, a right-wing coup took place in Peru, as a result of which left-wing leader Pedro Castillo was removed from office by the country’s congress. He was arrested and taken into custody after he announced the dissolution of Congress. Since then, Castillo has been serving his sentence at the Barbadillo Penitentiary Center.
