The National Association of Football Agents (ANAF) opposed the new FIFA Regulations on football agents this Wednesday, saying that their interests are not protected and there are articles that violate principles such as the principles of competition.
“This law does not protect two important issues, such as the interests of professional agents, because it does not reflect the practice that exists today. In this sense, it is an obscure law. It is isolated from commercial practices that have existed for many years,” criticizes Emanuel Calzada, Secretary General of ANAF.
Speaking to Lusa, the director also understands that the proposal “promotes a set of principles and legal rules that violate a set of rules guaranteed for many years (…) and violate the principles of free competition in Portugal and Europe. “.
As an example, he cited the fact of setting a commission ceiling depending on the remuneration that a football agent’s client will receive, which he considers “completely outdated, stupid rules.”
ANAF also protests the fact that the law “also wants to establish the way in which the agent will receive his commissions, depending on the type of term contract”, as well as the deadlines for receiving, tied to the duration of this bond.
“We are against this and are outraged. We will bring the legal consequences to the end, to the limit,” he promises.
In this sense, ANAF will provide itself with “valid legal opinions and opinions of the competent authorities” on the matter, emphasizing that the Antimonopoly Authority “should be heard”, not excluding the possibility of going to court: “If it must be so, it will be.”
“We are going to challenge, from a legal point of view, what we understand is wrong, and we are convinced that with the help of this set of actions we will achieve the most important thing, namely the restoration of the legal issue and justice and the correspondence between practical reality and norms,” he claimed.
Reasons for FIFA moving to the new regulation include, for example, limiting “abusive and excessive behavior by football agents”, avoiding “speculative markets” and “conflicts of interest”, or “increasing player protections”.
“ANAF was, is and always will be an organization that is guided by transparency, first of all and for all, but there must be a correspondence between the practice of those who make laws and the reality, which is not happening at the moment,” he objects to the leader.
A new regulation for FIFA football agents to reduce the maximum commissions received, ban dual representation or return to a global licensing system was approved on 16 December 2022 and came into effect on 9 January, kicking off the process. obtaining licenses.
From October 1, customers will be required to hire only licensed agents.
