Can Trump remain president? What the US Constitution says about whether a convicted felon can run for office

Former US President Donald Trump appeared before a New York court on Tuesday and pleaded not guilty to 34 counts.

He became the first former president in US history to be prosecuted, and despite his arrest, fingerprinting and court appearance, he remains a presidential candidate.

After the last Reuters/Ipsos Studies show Mr. Trump remains the GOP favorite in the 2024 presidential primaries anyway.

Will Trump be able to run for president after being impeached?

Legal experts say Trump could still run for president even if he faces criminal charges.

Richard Heisen, a professor of electoral law at UCLA, told CNN there is nothing in the Constitution that would prevent a presidential candidate from running if impeached or even convicted.

He said it’s unclear whether states can create barriers to presidential qualifications, as mandated in the constitution.

The US Constitution requires only three things from potential candidates: they must be citizens by birth, be at least 35 years old, and have lived in the US for at least 14 years.

However, if Trump is convicted on a criminal charge in New York, he will not be able to vote in Florida until he has served his term.

Will the accusation hurt Trump’s political chances?

In the poll, about 48 percent of Republicans said they want Trump to be their party’s presidential nominee, compared to 44 percent in the March 14-20 poll.

New York Timessaid Maggie Haberman in the paper Daily A podcast about some Republican voters feeling more loyal to Mr. Trump after the impeachment news broke.

Even Trump’s potential rivals, including DeSantis and his former vice president Mike Pence, have expressed support for him.

In addition to allegations of falsifying business records in New York, Trump will also face an investigation into the possession of classified documents at his Mar-a-Lago, Florida estate and an investigation into his alleged role in the January 6, 2021 attack on the US Capitol. . . .

There is also a separate investigation into attempts to reverse Trump’s minor defeat in Georgia’s 2020 presidential election. It is not known if the former president is being directly investigated, which focuses in part on Trump’s January 2, 2021 phone call with Georgian Foreign Minister Brad Raffensperger, a Republican.
