The essence of the action, aimed at children under 13, is to demonstrate that this platform does not apply the necessary mechanisms to prevent registration and use by children without the permission of parents or legal representatives. With regard to actions directed against users over 13 years old, we are talking about “misleading commercial practices” and “non-transparent privacy policies.”
Ius Omnibus estimates that there are 3.5 million users of the social network in Portugal alone. In order to secure eligibility for compensation, the NGO stated that users would have to register on the platform, which should be available online from that medium.
