
The intervention of the prosecutor’s office helped employees of the agricultural production cooperative breeding enterprise “Khanata” (SPK “Khanata”) in the Maloderbetovsky district of Kalmykia to receive wage arrears of more than 650 thousand rubles. This was reported on May 5 by the Republican news agency Stepnye Vesti, citing information from the Kalmykia Prosecutor’s Office.
As the agency became aware, during the period from January to February 2023, 42 employees of the Khanata SEC did not receive salaries in the total amount of more than 650 thousand rubles.
The prosecutor’s office and the State Labor Inspectorate began to investigate the incident.
The prosecutor made a presentation to the president of “Khanata”, and on the fact of violation of labor law, an appeal was sent to him to the court. An administrative case has been opened.
Let us remind you that in case of late payment of wages to an employee, the employer bears financial responsibility. The employer is obliged to pay the amount of the debt to employees with interest pursuant to art. 236 of the Labor Code of the Russian Federation. The employer is obliged to pay the debt to workers, taking into account compensation, regardless of the presence of their fault. In turn, the worker has the right to legitimate defense in case of delay in the payment of wages. If the payment of wages is delayed for more than 15 days, the employee has the right to suspend work for the entire period until the payment of the overdue amount (part 2 of article 142 of the Labor Code of the Russian Federation), notifying the employer written.
