The unconstitutionality appeal filed against the interim president of Peru, Dina Boluarte, in relation to the death of citizens during the repression of the protests, is inadmissible, which was recognized by the constitutionality subcommittee of Congress. On May 5, reports El Peruano.
It is reported that 11 congressmen voted in favor of the qualification report, which proposed declaring the accusation against the president inadmissible, while five opposed it. Three legislators abstained.
The appeal was presented by the deputy Ruth Luque, who also included in her complaint the former head of Government Pedro Angulo, the current Prime Minister Alberto Otarola, the former Minister of the Interior César Cervantes and the former Minister of Justice José Tello.
Deputy Edgard Raimundo raised the issue of re-examining the complaint and reviewing the qualification report on it. In this regard, he pointed out that the previous analysis did not take into account the report presented by the Inter-American Commission on Human Rights (IACHR) on the protests in Peru, published this week.
The report indicates that during the anti-government protests that began in December 2022, there were several acts of violence against law enforcement and damage to public infrastructure.
It is indicated that the events that occurred from December 7 of last year to February 2023 are being investigated by Congress and the Prosecutor’s Office, so the responsibility of any official in them has not yet been determined.
In this regard, given that the complaint did not conclusively establish whether there was excessive use of force by the military and police, and it was not shown that the officers denounced were aware of it, they could not be held responsible, as indicated in he a complaint.
Let us remember that the worsening of the political crisis in Peru occurred on December 7, 2022, when there was a right-wing coup, as a result of which the country’s congress removed the leftist leader Pedro Castillo from office. The legitimately elected president was arrested and imprisoned after the announcement of the dissolution of Congress.
Congress, which impeached the legitimately elected president Castillo, appointed Prime Minister Dina Boluarte as president. After the coup, massive protests began in different regions of Peru, during which, according to various sources, some 70 people died and more than 1,300 were injured. The demonstrators demand the release of Castillo, the dissolution of congress, the resignation of Boluarte and the holding of early elections.
