The Madeira District Court of Justice this Monday upheld the validity of Chega’s candidacy for the September 24 regional elections and dismissed the complaint filed by the ADN party for annulment, pointing out that there were no procedural violations.
The National Democratic Alternative (NDA) has already said it will appeal the decision to the Constitutional Court.
In a complaint filed with the Judicial Court of Comarca Madeira, the party claimed that Chega’s candidacy, led by Miguel Castro, was not accepted, given the decision of the Constitutional Court no. candidates for elections to the Regional Legislative Assembly of Madeira.
In a ruling published on Monday, the Judicial Court of Comarca Madeira clarifies that the judge’s intervention is limited to assessing possible procedural violations under the Electoral Law of the Legislative Assembly of the Autonomous Region of Madeira, which regulates issues related to the nomination of candidates.
“In this case, the complaint filed by the ADN – Alternative Democratic National Party concerns the decision delivered by the Constitutional Court through decision no. The decision of the Constitutional Court did not determine the termination of Chega’s party, the corresponding registration remains valid.”
“In view of the foregoing and without specifically referring to any procedural violations that prevent the preservation of the decision to admit the candidacy of the CHEGA party, the submitted complaint is rejected,” he concludes.
Meanwhile, DNA indicated that it would appeal the decision of the Madeira District Judicial Court to the Constitutional Court.
“We do not agree that our judicial system continues to protect and provide more rights to those who commit crimes or illegal acts,” he said in a statement.
ADN, led by Miguel Pita in the September 24 elections, believes that the Madeira District Judicial Court decided to “shake the water off the cloak” and, on the other hand, criticizes the “silence” of other candidates.
“For what reason did all the other parties decide to risk the future of all the people of Madeira and Porto Santens by remaining silent and not challenging the illegal list?” he asks.
The party also emphasizes that “it is against this type of play of interests that dominates national politics that the DNA rises up and fights, no matter who is targeted.”
In the elections on September 24, the Madeiran court approved 13 candidates, corresponding to two coalitions and 11 other parties, but the final lists will not be published until September 4.
As a result of the distribution of 13 political forces on the ballot, the Portuguese Labor Party (PTP) ranked first, followed by Juntos Pelo Povo (DPP), Blok de Esquerda (BE), Socialist Party (PS), Chega (CH), React Include Integrate (RIR), Party of the Earth (MPT), National Democratic Alternative (ADN), Somoz Madeira (PSD/CDS-PP coalition), People-Animals-Nature (PAN), Livre (L), CDU – – Unitary Democratic Coalition ( PCP/PEV) and the Liberal Initiative (IL).
The previous regional elections were held on September 22, 2019.
In this election, in one district, 16 parties and a coalition competed for 47 seats in the Parliament of Madeira: SDP, PS, CDS-PP, JPP, BE, Chega, IL, PAN, PDR, PTP, PNR, Aliança, Partido da Terra – MPT, PCTP/MRPP, PURP, RIR and CDU (PCP/PEV).
The PSD then lost for the first time the absolute majority in the Madeira Regional Legislative Assembly, which it had held since 1976, electing 21 deputies and forming a coalition government with the SDS-PP (three deputies).
The PS elected 19 deputies, three from the AKP and one from the PKP.
