The Court of Appeal of Porto (COR) reduced the prison sentence of a man living in Anadia, Aveiro district, from eight to seven years, who raped a minor, his niece, according to the ruling of this court.
The decision of the TRP of July 12, which Lusa read today, partially granted the appeal filed by the defendant.
In December 2022, a 58-year-old man was sentenced by an Aveiro court to a single sentence of eight years in prison statutory for 477 offenses of aggravated child sexual abuse.
In addition to imprisonment, he was also sentenced to pay compensation in the amount of 40 thousand euros to the victim, who is now 15 years old, who is also prohibited from trusting a minor and from engaging in a profession whose activities involve regular contact with minors. , for a period of 10 years.
Dissatisfied with the decision, the defendant turned to the High Court of Porto, which realized that he had committed fewer crimes than those for which he was convicted in the first instance.
“If you count, then in the 2020/21 academic year, taking into account only one day of the fifth year of study, the actions occurred at least 52 times, and in the 2021/22 academic year, taking into account two days up to and including October, 18 times, which is not counted in total. less than 70 times,” the verdict says.
Although the defendant has seen the number of crimes he has been charged with “substantially” reduced, the judges say the fact that his practice is proving to be “heinous and serious” cannot be ignored by imposing a single sentence of seven years in prison.
The victim was taken away from her parents and handed over to the defendant and the woman, the child’s paternal aunt, in 2015, who has since lived with her uncles and aunts.
The facts cited as proven evidence that the violations occurred when the minor entered the 5th grade and continued until October 2021.
The violations occurred while the accused was at home alone with the victim.
