The trial of two doctors accused of amputating a woman’s healthy breast in 2016 began today at the Bolhan court in Porto. Both surgeons refused to testify, and only the victim was heard.
The trial began after the defense attempted to delay it, arguing it was awaiting an “important” technical report, which was rejected by the judge.
Subsequently, lawyers for the two surgeons argued that the criminal case had already expired, which the prosecutor’s office and the prosecutor’s office opposed, saying that the criminal case would only expire in September 2026.
In the morning, Susana Tome was heard in March 2016, after cancer, entering the operating room to remove her right breast, amputating both, without signing a release form.
“More than seven years after the facts, the trial will continue and justice resulting from the evidence presented will be restored. If it is proven, the crime will be punished. If it is not proven, it will be acquitted, that’s how it happens. there must be,” he told reporters and Suzana Tome’s lawyer.
Rui da Silva Leal explained that “what is at stake is knowledge of whether the applicant has consented to a particular surgical procedure. That’s all that’s at stake.”
In a highly emotional report to the judge in Bogliana’s court, Susana Tome said that after the operation her “feminine essence” had disappeared.
After leaving the hearing, Suzanne Thome said she left “completely convinced that they continue to try to detain.” “This case is based on fact, which is based on the informed consent that I signed and which was not respected by these two defendants. They try to get around it by other means and in other ways, which is very simple. “
“Seven years, six months and six days” after the operation, Suzanne Thome, who became an assistant in the process, continues to wait for “two doctors to be held accountable” for an act that destroyed “part” of her life. .
They tried to propose an agreement on March 2, “but showed no interest in it, which for me was just another pleasure that made me suffer even more. For me this is unforgivable.”
The trial will continue in the afternoon, with a new hearing already scheduled for the 21st of this month.
The doctors in question were punished by the Medical Association with suspension of activity: in one case for 10 days, in another for 21 days.
