Two Marines, Claudio Coimbre and Vadim Grinko, who were provisionally arrested for the death of Fabio Guerra, a PSP agent, six months ago on a Lisbon night, are now charged with aggravated murder.
The third suspect, Clovis Abreu, remains unknown.
In the decision (analysis of the appeals), which was reviewed by the CM, the judges considered that “there is no danger of disturbing public order”. But they retained the preventive measures, accused of the qualified murder of Fabio Guerra and attacks on three other police officers. This is due to the fact that Claudio Coimbra and Vadim Grinko could “put pressure on witnesses, preventing them from cooperating with justice.” The ruling refers to the prosecutor’s office, according to which there are witnesses who fear reprisals and “asked to apply the witness protection regime.” “Contact between the accused and witnesses at this stage of the investigation may influence the testimony of witnesses, slow them down, therefore, it is concluded that there is a real danger of hindering the investigation.” Both elicit an “aggressive personality and are prone to little attention and cause justified fear” of “using significant violence to deter third parties from intervening in the future.”
The defense argued that there was no intent to kill and, among other things, the presumption of innocence was not respected, that the PPPs did not identify themselves, were not appeased and were intoxicated.
