The Constitutional Court rejected the euthanasia law for the third time, deeming it “unconstitutional.” The Labor Code considered that the “right to life” cannot be legislated. The law on euthanasia has been under discussion for five years, despite the fact that it has already been approved by the Assembly of the Republic.
Medically assisted death is no longer punishable if it occurs “by the decision of an older person, whose will is current and repeatable, serious, free and clear, in a situation of great suffering, with a final injury of extreme severity. or the disease is serious and incurable if it is practiced or helped by medical workers,” said the President of the Constitutional Court.
The President of the Republic this Monday vetoed an unconstitutional parliamentary decree that would decriminalize the expectation of medically assisted death, as required by the Constitution, following a ruling by the Constitutional Court.
This decision was announced through a note on the official website of the President of the Republic on the Internet after the Constitutional Court declared unconstitutional some of the norms of this diploma, submitted for preventive verification by the head of state, Marcelo Rebelo de Souza.
“Having ruled this Monday on the unconstitutionality of the provisions of the new version of the decree of the Assembly of the Republic on death by a doctor, the President of the Republic will again return the diploma to the Assembly of the Republic without promulgation. in accordance with article 279, number 1, of the Constitution, as soon as the decision of this court is published in the Diário da República,” reads a footnote containing only this paragraph.
The Constitution determines that, in the event of a declaration by the Constitutional Court of unconstitutionality, the diploma must be vetoed by the President of the Republic and returned, in this case, to Parliament, which may amend its wording, removing content deemed unconstitutional, or confirm it by a two-thirds majority.
PS announced on Monday that it will correct the norms declared unconstitutional by the Constitutional Court, claims that it is only a question of “meaning” and that most of the arguments of the President of the Republic have not been successful.
The President of the Republic, Marcelo Rebelo de Souza, submitted the euthanasia law for the third time to the Constitutional Court, which again failed. The final text on the decriminalization of violent death was approved by a parliamentary committee.
The Euthanasia Act took into account votes for PS, IL, and BE, votes against Chega and PCP, and abstentions from PSD.
