The first instance of the Court of Justice of the European Union (CJEU) ruled this Wednesday that the name “Pablo Escobar” cannot be registered as a trademark in the EU due to its association with the Colombian narco-terrorist.
In its statement, the General Court of the EU, the first instance of the CJEU, explained that on September 30, 2021, the company Escobar Inc., based in Puerto Rico, USA, applied to register the name “Pablo Escobar.” “for a “wide range of goods and services.”
The EU Intellectual Property Office rejected the request, stating that the mark was “contrary to public order and good customs,” based on the perception of the Spanish public, “since they are the ones who know Pablo Escobar best due to the relationship between Spain and Colombia.”
