The General Court of the European Union (EU) this Wednesday stripped McDonald’s of exclusivity of the Big Mac brand after the North American fast food multinational failed to demonstrate its “serious use.”
This is a complaint brought by Irish fast food company Supermac’s, which in 2017 filed a request to remove the Big Mac brand from the EU in relation to poultry and poultry-based sandwiches, as well as services “provided in connection with the operation of restaurants and other establishments or catering facilities for consumption and travel, as well as the preparation of food for takeaway,” the court statement said.
Supermac’s said McDonald’s, which has owned the trademark since 1996, had failed to demonstrate genuine EU use of the products in question over a continuous five-year period.
With today’s ruling, the General Court reverses and partially reforms the decision of the European Union Intellectual Property Office that included poultry products and sandwiches in the protection granted by McDonald’s for the Big Mac brand and services related to it. for the work of restaurants.
