Jessica Biscay’s death decision will not have a jury trial (three judges and four jurors) as the State Department intended.
The Court of Setúbal recalls that, in the order in which cm had access that cases of terrorism and highly organized crime (including drug trafficking) do not allow trial by jury. Thus, this case “does not allow jury intervention in the trial due to a constitutional impossibility,” Judge Paula Sa Couto concludes.
The defendants (four members of the same family and the girl’s mother) are also responsible for murder, kidnapping, physical crimes and rape. Three-year-old Jessica was raped and beaten to death last June. Later, the mother did not call for help in time.
