Effective arrest of a man who tried to kill another in Caldas da Rainha

The Leiria Judiciary Court on Tuesday sentenced a man to four years and six months in prison for aggravated crimes, attempted simple murder and attempted aggravated coercion in Caldas da Rainha.

The panel of judges recognized the charge as partially substantiated and proven, with an insignificant change in the facts and legal qualifications, and sentenced the defendant to nine months in prison for a crime with aggravating circumstances, to four years in prison for a simple attempted murder. and to one year in prison for attempted aggravated coercion.

Legally speaking, the man was sentenced to a single term of imprisonment of four years and six months.

The court, which acquitted the defendant in the case of domestic violence, also found the claim for damages partially satisfied and proved, awarding the defendant 7,500 euros to pay the man.

The court found that in May 2021, the 55-year-old defendant began a romantic relationship with a woman who has since lived in the municipality of Caldas da Rainha.

The following month, when his partner and the man left the room where the defendant and others were, he used the following expressions: “Don’t get in his car or I’ll set the car on fire with you.” two inside.

When the man took his mobile phone to call the National Republican Guard, the defendant “stabbed him in the neck” with a razor, who was also pushed, “falling helplessly” to the ground.

The Collective Court also argued that the defendant acted in the manner described and uttered these expressions with awareness and knowledge of their objective meaning and that they were capable of arousing in the partner and in the man “fear and apprehension for his physical integrity and life”. , restrict their freedom of their decisions and actions and determine them not to leave the place together, declaring that if they do, it will be an attempt on their lives, which they represented, wanted and only did not achieve for reasons beyond their control. your will.”

According to the judges, the defendant, who had a criminal record and was previously detained, addressing his partner, who had died in the meantime, “realized their objective meaning and that they were capable of causing him fear and fear for his physical integrity and life.”

On the other hand, when using a razor against a person, he knew that he “has reached areas of the body with vital organs and that such actions are capable of putting an end to the life” of that person, “acting for this purpose, which just did not materialize for reasons unrelated to your will.”
