The criminal judge of Évora declared the measure of compulsion to establish the identity and residence of Eduardo Cabrita, applied in this trial, canceled.
On June 18, 2021, Nuno Santos, an employee of a company carrying out repair work on the A6 motorway in the municipality of Évora, was killed by a car carrying the then Minister of the Interior.
Criminal Judge Marcos Ramos also decided not to prosecute former government security chief Nuno Diaz for murder by simple or gross negligence, as well as for dangerous driving of a road vehicle.
The court found that Nuno Dias “did not have any hierarchical relationship with the accused Marco Pontes, a driver capable of giving clear instructions regarding the manner of driving the vehicle.”
“Nuno Diaz was not a guarantor of the safety of pedestrians on the road,” the court found, finding that other issues, namely the attribution of gross negligence, were raised.
“We conclude that the elements of the case do not support the allegation of the criminal omission of Nuno Dias and his corresponding culpability in the death of Nuno Santos, and his conviction in the present case is unlikely,” the judge said, adding that since there are no “constituent elements crime of murder,” it is necessary that the accused Nuno Diaz “not be prosecuted.”
As for the driver of the vehicle, the judge ordered Marco Pontes to be held accountable for committing a crime in which the authorship of the materials was committed through gross negligence, combined with the commission of an “administrative offense classified as serious” under the traffic rules.
However, the judge decided not to prosecute Marco Pontes for dangerous driving of a road vehicle.
